Terms of Booking

By purchasing your stay at La Vue SXM (“La Vue SXM LLC” or “LaVueSXM”), via www.lavuesxm.com, you (the “Lead Guest”) and your booking party (the “Guests”) agree to the following terms and conditions as set-out in the Terms of Service (the “Agreement”). Throughout the duration of the stay, the Lead Guest and the Guests agree to abide by the subsequent conditions as set-out. If there are any questions, please contact host@lavuesxm.com before purchasing and finalizing the reservation.

Note: The Lead Guest must be at least 21 years of age.

Where the person making the booking is different to the Lead Guest taking up the occupation, the person making the booking may be held responsible for cancellation, non-arrival and damages as set out within. Only the Lead Guest and the Guests can use the property and its facilities, any third-party visitors are only allowed access at our express permission.

Maximum Occupancy

Villa La Vue:

The maximum number of staying guests per room is two (2) adults, and the total villa occupancy is six (6) adults (plus an additional 2 children under 12 years of age) at Villa La Vue. An additional fee for extra guests will be added to the daily rate.

Villa Rosa:

The maximum number of staying guests per room is two (2) adults, and the total villa occupancy is ten (10) adults.

Damage Deposit

A Damage Deposit in the amount of $1,500 USD is to be paid in advance by Lead Guest, or on day of their arrival on the property. Lead Guest agrees to provide the total cost of the damage deposit in the amount listed on the site ($1,500 USD) to secure pledge of full compliance with the terms of the Agreement. If there is damage present to the property, the Lead Guest will not be reimbursed the full Damage Deposit and may be fully liable for a credit card transaction fee in addition to the additional charges to repair any damages, including cost of labor. LaVueSXM will inspect the property at the conclusion of the Lead Guest’s stay. Lead Guest will not be held responsible for items that break or become damaged through normal wear and tear. Any damage that appears malicious or excessive will be repaired with the funds held for damages and any amount that should exceed the amount held as a deposit will be collected from the Lead Guest (and/or Guests) through all means available including legal action. In the event the Lead Guest and LaVueSXM cannot reach an agreement as to any disputed damage amount, such amount shall be determined by LaVueSXM in their sole discretion.

Check-In & Check-Out

Guests must check-in and check-out by the times stated below: ·        

  • Check-in :  Between 16:00 pm and 21:00 pm on day of arrival        

  • Check-out : No later than 11:00 am on day of departure

If Lead Guest would like to customize check-in and check-out times, they must contact host@lavuesxm.com for written approval.  

Cancellation & Non-Arrival Conditions

Lead Guest who needs to cancel their booking should contact LaVueSXM (host@lavuesxm.com) as soon as possible. Bookings already paid are only returned in accordance with the following conditions: ·        

  • Cancellation made 31 days or more in advance of arrival date = Full refund on total value of reservation ·        

  • Cancellation made 30 days to 15 days before = 50% refund of total value of reservation ·        

  • Cancellation made 14 days or less of arrival date = No refund issued on total value of reservation

    Non-arrival guests, who are unable to attend or fail to attend for whatever reason, forfeit the full amount of their paid reservation. In the rare event we need to cancel your booking with us, please be aware that we cannot be held liable for circumstances beyond our control and that our liability to you is limited to the refund of any payment already made.

WiFi Fair & Appropriate Usage Policy

Where WiFi Internet access is provided, Lead Guest and Guests accept to use this access to the Internet fairly and appropriately. We may monitor network performance and user usage to maintain a fair and high level of service to all our guests. The Internet access provided is intended for general use such as access to the world wide web, email, messaging, social media, light video / music / media streaming. Access to illegal activity or use of our network for illegal activity is not prohibited and will be reported to local authorities.

Phone Usage Policy

Lead Guest and Guests are not allowed to make international calls (outbound outside of the country of Sint Maarten) from the landline phone. Failure to abide will result in a fine. LaVueSXM receives call logs from the landline phone at the end of each month and has full visibility on the type of calls made during the Lead Guest’s stay.

Damages & Lost Property

We reserve the right to charge the Lead Guest for any damages caused through the course of a booking by any member of the booking party. This includes breakages, spillages, stains, damage to furniture or fixtures and fittings. Any accidental damages should be reported as soon as possible in order to minimize damage and associated costs. Lost keys / fobs will incur a replacement charge per key / fob lost. Lost keys will incur replacement costs of $25 USD. A lost safe key will require that the entire safe be replaced at a cost of $175 USD. This fine will be deducted from the Damage Deposit. Any lost property, if discovered and found, left behind by Guests during a stay will be held for a period of one (1) month. While we will make our best efforts to reunite lost property with their owners, we accept no responsibility in replacing lost items and encourage guests to ensure they have all their belonging before check-out. We may offer to post lost items via recorded delivery at the cost of the property owner, otherwise collection can be arranged.

Removal of Property

Lead Guest and Guests agree not to remove or alter in any way property within the villa. Any removal or alteration of the property without permission shall constitute a violation of the Agreement.  

Smoking

Smoking of any tobacco and cannabis products including, but not limited to cigarettes, pipes, cigars, snuff or chewing tobacco, is prohibited in the villa. Smoking of any kind is not allowed inside or outside the villa, including the outdoor patio and pool area (including the community pool). Lead Guest and Guests agree not to smoke in the house at any time. Lead Guest will be liable for an additional $300 cleaning fee if evidence of any smoking or related activity is discovered by LaVueSXM management. This fine will be deducted from the Damage Deposit.

Underage Drinking / Illegal Drugs

Lead Guest and Guests agree not to allow anyone under the age of 21 to consume alcoholic beverages on the premises. Lead Guest and Guests agree not to use nor permit the use of any non-prescription drugs on the premises.

Assumption Of Risk

There are no lifeguards on duty in St. Maarten. Accordingly, persons using the beach or pool do so at their own risk and LaVueSXM assumes no responsibility for accident or injury. No one should swim alone. Lead Guest and Guests will hold LaVueSXM harmless from all bodily injury and/or property damage incurred on the property arising out of Lead Guest and Guests’ negligent acts or omissions.

Child Proofing

Lead Guest understands that no special efforts have been made to “childproof” the villa and accepts the risk or harm to any children we allow on the property. These risks are not limited to, but include access to the ocean, pool, adjacent street, cleaning supplies in the house and plants surrounding the house that might be poisonous if ingested. LaVueSXM is built on two levels and there are is one full set of tiled stairs that must be used to go from the living areas to the bedroom levels

Pets & Service Dogs

We do not accept pets throughout the accommodation, except for Service Dogs. If an express written request is made, exceptions can be made dependent on situation and size of pet. No pets over 15 lbs are allowed on premises.

Parking

On-site parking is provided at the villa for a maximum of two vehicles. Lead Guest accepts that they park their vehicles at their own risk in other areas.

Our Right to Cancellation

We reserve the right to cancel any booking without compensation, refund, or reimbursement if the terms of these conditions are breached.

Choice of Law and Venue

The Agreement shall be governed by the laws of the State of New Jersey. Any lawsuits or legal action brought under or related to this Agreement shall be brought in the State of New Jersey, unless both parties mutually agree to a different venue.
